The investigation began when the NDMV contracted a private firm to develop a vehicle identification database. The system quickly revealed a disturbing pattern: over 4,000 false certificates were issued in Las Vegas during 2008 alone. According to court documents, Waked knowingly submitted false emissions test results to the NDMV. He was charged with violating 42 U.S.C. 7413(c)(2)(A), which specifically prohibits knowingly making false statements, representations, or certifications, or omitting material information in any notice, application, or record related to Clean Air Act compliance. The indictment, filed in January 2010, alleged that Waked and his co-defendants operated at various testing locations throughout the Las Vegas area, collectively contributing to the massive number of fraudulent certificates.
A Systemic Problem
The scale of the fraud is particularly troubling given that Las Vegas and Clark County are designated as “non-attainment” areas by the EPA for carbon monoxide and ozone. This means the region consistently fails to meet federal air quality standards, necessitating mandatory vehicle emissions testing programs. By falsifying test results, Waked and his associates undermined the purpose of these programs, potentially exposing residents to higher levels of harmful pollutants. The Department of Justice noted that all nine other defendants in the case had also pleaded guilty.
