Bernard Andrew Wagner, Attempted Enticement of a Minor, South Dakota 2022

Wagner, Bernard Andrew Wagner, Jr., 59, of Spearfish, South Dakota, was sentenced to 10 years in federal prison for attempting to entice a minor using the internet.

On March 28, 2022, U.S. District Judge Jeffrey L. Viken handed down the sentence, which also includes five years of supervised release and a $100 special assessment to the Federal Crime Victims Fund.

Wagner will also be required to register as a sex offender under the Sex Offender Registration and Notification Act.

The 59-year-old man was federally indicted and arrested after attempting to sexually entice an undercover law enforcement agent posing as a minor. Wagner started sending inappropriate messages to a 15-year-old female he knew personally.

This case was investigated by the South Dakota Division of Criminal Investigation, Homeland Security Investigations, Spearfish Police Department, Rapid City Police Department, and the Pennington County Sheriff’s office.

Assistant U.S. Attorney Sarah B. Collins prosecuted the case, which ended with Wagner being immediately turned over to the custody of the U.S. Marshals Service.

Wagner, who now faces the harsh reality of his actions, will spend the next decade in federal prison as a result of his attempted online predation.

The case serves as a stark reminder of the importance of online safety and the devastating consequences of attempting to harm a minor.
