Waupaca County, Gender Discrimination, Wisconsin 2006

Waupaca County, Wisconsin, is facing a federal lawsuit alleging gender discrimination against one of its own employees. The Justice Department filed the complaint on behalf of former Waupaca County Sheriff’s Department patrol officer Julie Ann Thobaben.

Thobaben, a 16-year veteran of the Waupaca County Sheriff’s Department, was allegedly denied a promotion from patrol officer to detective sergeant in March 2006 due to her gender. Despite being the most qualified candidate for the position, the county’s managers cited a nepotism policy as the reason for denying Thobaben the promotion. The policy prohibits employees from supervising their relatives, but the complaint alleges that the county has ignored this policy on at least 10 other occasions when it permitted males to supervise their family members.

The county’s actions, the complaint alleges, were a clear case of gender discrimination. Title VII of the Civil Rights Act prohibits employers from discriminating against individuals based on their race, color, gender, national origin, or religion when making employment-related decisions, including decisions about whether to promote, hire, or fire someone.

The lawsuit, which was filed in federal district court in Wisconsin, is a stark reminder that gender discrimination in employment will not be tolerated. As Assistant Attorney General Thomas Perez said, “Gender discrimination in employment will not be tolerated. This lawsuit should send a clear message that the department will take necessary action to eliminate and remedy the effects of gender discrimination in our public sector workplaces.”

Waupaca County, the defendant in this case, is a county located in Wisconsin. The alleged crime, gender discrimination, occurred in March 2006. The case is currently pending in federal district court in Wisconsin.
