West Virginia Correctional Officer Sentenced for Smuggling Contraband to Prisoners

BECKLEY, W.Va. – A former correctional officer at the Federal Correctional Institution (FCI) Beckley in West Virginia has been sentenced to prison for providing contraband to federal prisoners.

Cody Adam Bays, 32, of Beaver, was sentenced to one year and six months in prison, to be followed by three years of supervised release, for his role in providing contraband items to inmates at FCI Beckley. Bays admitted to providing various controlled substances, including suboxone, marijuana, synthetic marijuana, and tobacco, to the inmates.

According to court documents and statements made in court, the illicit activity took place between November 7, 2022, and February 14, 2023. Bays profited from this activity, receiving approximately $20,800 in cash or through financial mobile applications. He was paid $5,000 for suboxone, $4,000 for fentanyl, $3,500 for synthetic marijuana, and $2,000 for marijuana.

Bays’ actions did not go unnoticed. The U.S. Department of Justice-Office of Inspector General (DOJ-OIG) conducted an investigation, which led to the discovery of Bays’ involvement in a multi-state drug trafficking criminal enterprise.

United States Attorney Will Thompson commended the investigative work of the DOJ-OIG and announced the sentencing. United States District Judge Frank W. Volk imposed the sentence, while Assistant United States Attorney Brian D. Parsons prosecuted the case.

A copy of the press release is located on the website of the U.S. Attorney’s Office for the Southern District of West Virginia. Related court documents and information can be found on PACER by searching for Case No. 5:23-cr-165.

The case serves as a reminder of the serious consequences of corruption within the prison system. Bays’ actions not only compromised the safety and security of the prison but also undermined the trust of the public in law enforcement.

As the investigation continues, it is clear that the U.S. Attorney’s Office and the DOJ-OIG will not tolerate corruption of this nature. The sentencing of Cody Adam Bays is a testament to their commitment to justice and accountability.
