BOSTON, Mass. – A pair of West Springfield men have been hit with federal charges for falsifying driving logs and making false statements to investigators, a move that comes after a deadly crash involving one of their company’s vehicles left seven motorcyclists dead in New Hampshire.
Dunyadar Gasanov, 36, also known as Damien Gasanov, has been indicted on three counts: falsification of records, conspiracy to falsify records, and making a false statement to a federal investigator. His brother, Dartanayan Gasanov, 35, faces one count of falsification of records.
According to the indictment, the brothers owned and operated Westfield Transport, Inc., a for-hire interstate motor carrier that transported vehicles primarily in the northeastern United States. It’s alleged that from May 3, 2019, to June 23, 2019, the brothers manipulated driving logs to evade federal regulations, which are in place to ensure road safety and driver well-being.
The indictment claims that Dunyadar Gasanov instructed at least one employee to falsify records, leading to drivers exceeding permissible driving hours. He also allegedly made a false statement to a federal inspector regarding the manipulation of recording devices that track drivers’ on and off-duty hours.
If convicted, Dunyadar Gasanov faces up to 20 years in prison, three years of supervised release, and a fine of $1 million. Dartanayan Gasanov could receive up to five years in prison, three years of supervised release, and a fine of $250,000.
U.S. Attorney Andrew E. Lelling and Daniel Helzner, Acting Special Agent in Charge of the U.S. Department of Transportation, Office of Inspector General, Office of Investigations, made the announcement.
Assistant U.S. Attorney Neil L. Desroches of Lelling’s Springfield Office is prosecuting the case. The details contained in the indictment are allegations, and the defendants are presumed innocent unless proven guilty beyond a reasonable doubt in a court of law.
