A brutal sexual assault in Porcupine, South Dakota has led to a federal indictment. William Thunder Hawk, 19, is accused of attempting to sexually abuse a female near Porcupine in August 2012.
According to the charges, Thunder Hawk allegedly physically and sexually assaulted the victim, leaving her with serious injuries. The incident occurred in August 2012, but it wasn’t until March 25, 2013 that a federal grand jury indicted Thunder Hawk on Attempted Aggravated Sexual Abuse, Assault with a Dangerous Weapon, and Assault Resulting in Serious Bodily Injury.
Thunder Hawk appeared before U.S. Magistrate Judge Veronica L. Duffy on March 25, 2013 and pleaded not guilty to the indictment. The maximum penalty upon conviction is life imprisonment and a $250,000 fine.
The investigation is being conducted by the Bureau of Indian Affairs, Office of Justice Services, and the Oglala Sioux Tribe Department of Public Safety. Assistant U.S. Attorney Wayne Venhuizen is prosecuting the case.
Thunder Hawk was remanded to the custody of the U.S. Marshal. A trial date has been set for May 28, 2013. The charges against Thunder Hawk are mere accusations, and he is presumed innocent until proven guilty.
