Hamburg, N.Y. – The U.S. Attorney’s Office in New York announced today that Gerald T. Przybylski, 78, of Hamburg, NY, has been arrested and charged with transmitting threats to a member of Congress using the internet. The charge carries a maximum penalty of five years in prison and a $250,000 fine.
Assistant U.S. Attorney Charles M. Kruly revealed that Przybylski sent a menacing email to a member of the U.S. House of Representatives on June 13, 2025. In the message, Przybylski suggested legal execution under the Constitution for Donald Trump and his Republican colleagues, calling the recipient a traitor and urging them to fear for their life.
During an interview with law enforcement, Przybylski admitted that he likely intended to scare the recipient. The defendant appeared before U.S. Magistrate Judge Michael J. Roemer and was released on conditions pending further proceedings.
The charges stem from a joint investigation involving the Erie County Sheriff’s Office, the United States Secret Service, the Federal Bureau of Investigation, and the United States Capitol Police.
Gerald Przybylski is presumed innocent until proven guilty, according to the legal process. The case serves as a stark reminder of the potential dangers associated with cyber threats against public officials.
U.S. Attorney Michael DiGiacomo emphasized the seriousness of the charge and the ongoing efforts to protect members of Congress from such threats.
