Men Caught with Marijuana
Three men from Rapid City and Mission, South Dakota, have been sentenced for their involvement in a marijuana possession case.
According to court documents, Dennis Red Elk, 32, was sentenced to 5 months in prison, a $1,000 fine, and $25 special assessment to the Victim Assistance Fund. Maurice Johnson, 33, received time served, a $1,000 fine, and $25 special assessment to the Victim Assistance Fund. Daniel Gangone, 35, was sentenced to 12 months of probation, a $1,000 fine, and $25 special assessment to the Victim Assistance Fund.
The investigation, conducted by the Northern Plains Safe Trails Drug Enforcement Task Force, began on March 27, 2010, after Red Elk and Johnson were discovered to have marijuana in their possession during contact with law enforcement officers. Gangone was later implicated in the investigation.
Red Elk was immediately turned over to the custody of the U.S. Marshal Service after his sentencing. Johnson will be turned over to state authorities for a parole violation.
Assistant U.S. Attorney Kathryn N. Rich prosecuted the case, which stemmed from a Superseding Information filed on January 17, 2013. Red Elk and Johnson had initially been indicted by a federal grand jury on August 22, 2012.
The case serves as a reminder of the consequences of marijuana possession and the importance of ongoing efforts to combat drug trafficking in South Dakota.
