A 31-year-old Eagle Butte man, Kimo Little Bird, Sr., has pleaded guilty to being a felon in possession of a firearm, a crime that could land him behind bars for up to 10 years. According to U.S. Attorney Brendan V. Johnson, the conviction stems from an incident in December 2012, when law enforcement found a firearm at the residence where Little Bird was staying.

Little Bird was arrested for an outstanding tribal warrant at the time. When questioned about the firearm, he admitted that it belonged to him and that he knew he was prohibited from possessing firearms due to a previous felony conviction.

The investigation into Little Bird’s firearm possession was a joint effort between the U.S. Fish & Wildlife, Bureau of Alcohol, Tobacco, Firearms & Explosives, Federal Bureau of Investigation, and the Bureau of Indian Affairs, Standing Rock Agency.

Assistant U.S. Attorney Troy Morley is handling the case, which is set to head to sentencing on May 20, 2013. A presentence investigation has been ordered, and Little Bird remains in the custody of the U.S. Marshal pending sentencing.

The maximum penalty for Little Bird’s conviction includes a 10-year prison sentence, a $250,000 fine, or both, and a period of supervised release of 3 years.
