Lower Brule Man Sentenced for XLR-11 Possession

A Lower Brule, South Dakota man has been sentenced to 4 months in custody for Possession of a Controlled Substance Analogue, according to federal authorities.

Joshua Brouse, 30, was sentenced on December 23, 2013, by U.S. Magistrate Judge Mark A. Moreno for his role in the possession of XLR-11, a Schedule I controlled substance analogue.

On February 22, 2013, a package addressed to Brouse was delivered by FedEx to the Lower Brule Tribal Building. Brouse attempted to retrieve the package from law enforcement by personally coming to the tribal building and by sending others to retrieve the package.

After obtaining a search warrant, law enforcement discovered the package contained 24 sealed plastic bottles containing approximately 4 grams each of XLR-11.

Brouse knowingly purchased and attempted to possess the XLR-11 substance, leading to his indictment by a federal grand jury on May 15, 2013. He pled guilty on November 26, 2013.

The case was investigated by the Northern Plains Safe Trails Drug Enforcement Task Force and prosecuted by Assistant U.S. Attorney Kathryn N. Rich. Brouse is to self-report to the custody of the U.S. Marshals Service by noon on December 30, 2013. He will also serve 1 year of Supervised Release and pay a $1,000 fine, along with a $25 special assessment to the Federal Crime Victims Fund.
