St. Thomas, USVI — A 23-year-old local man is facing federal time after being caught peddling crack cocaine within spitting distance of a high school. Tomolah Foy has been indicted on four counts of possessing with intent to distribute crack cocaine within 1,000 feet of Ivanna Eudora Kean High School, a zone that triggers harsher penalties under federal law.
The charges stem from a string of drug transactions and attempted sales in the Red Hook neighborhood during November and December of 2016. According to the indictment, Foy didn’t just skirt the law—he allegedly operated in plain sight near one of the territory’s key educational campuses, turning school grounds into a shadow marketplace for crack.
Foy made his initial court appearance on December 12, 2016, before U.S. Magistrate Judge Ruth Miller. He’s currently on pretrial release, but if convicted, he’s staring down a maximum sentence of 40 years behind bars, a $2,000,000 fine, and no less than six years of supervised release. Federal prosecutors aren’t cutting corners when drugs flood school zones.
The Bureau of Alcohol, Tobacco, Firearms and Explosives led the investigation, building a case that underscores the feds’ focus on curtailing drug activity near youth centers. Assistant United States Attorney Everard E. Potter is handling the prosecution, aiming to send a message that trafficking near schools won’t be tolerated in the U.S. Virgin Islands.
U.S. Attorney Ronald W. Sharpe confirmed the indictment and reminded the public that an indictment is not a conviction. “Every defendant is presumed innocent until and unless found guilty,” Sharpe stated. But the evidence, if proven, paints a grim picture of a man exploiting vulnerable communities.
The case remains active. As federal authorities tighten their grip on drug networks in the territory, Foy’s name now sits squarely in their crosshairs. For residents of Red Hook, the outcome could signal whether justice catches up with those who turn school zones into open-air drug markets.
