Robert Klyvert, Crack Cocaine Distribution, California 2019

Robert Klyvert, 47, of St. Croix, is headed to federal prison for five years after being sentenced Monday for distribution of crack cocaine. U.S. Attorney Gretchen C.F. Shappert confirmed the sentencing, which marks the end of a years-long investigation into a failed drug deal that unraveled through text messages, wiretaps, and a confidential human source.

Visiting Judge Anne E. Thompson handed down the 60-month sentence, followed by five years of supervised release. Klyvert was also ordered to pay a $1,000 fine and a $100 special assessment. The judgment comes after Klyvert, known by the street alias “Family,” pleaded guilty on January 29, 2019, to one count of crack cocaine distribution in the U.S. District Court for the Virgin Islands.

Court documents reveal that in September 2016, Klyvert approached a confidential human source (CHS) offering to supply cocaine directly, citing the death of a previous drug associate. Over the next several months, he exchanged a series of phone calls and text messages detailing plans to move a kilogram of cocaine from Florida to the U.S. Virgin Islands. He told the CHS the drugs would be fronted, with $25,000 due after the kilo was sold within a week.

Klyvert explicitly warned the source the cocaine wasn’t suitable for snorting—calling it unfit for “the nose”—and instead ideal for conversion into crack. He promised a second kilogram would follow on January 2, 2017, if the first deal went smoothly. On December 27, 2016, Klyvert sent the CHS the contact number for the supplier in Orlando, later identified as Nolly King, Jr., whose home address was used for the handoff.

The CHS received the drugs on December 30, 2016. Lab analysis confirmed the substance as 884.18 grams of cocaine base and cocaine hydrochloride—nearly a full kilo, but short by about 4 ounces. Three days later, Klyvert texted the CHS, reducing the payment to $22,000 due to the shortage, though the original $25,000 had been agreed upon. That same day, the deal collapsed under federal scrutiny.

Klyvert was indicted by a federal grand jury on April 13, 2017. The case was investigated by the FBI with support from the DEA and prosecuted by Assistant U.S. Attorneys Rhonda Williams-Henry and Melissa Ortiz. Nolly King, Jr. was later charged, pleaded guilty, and was sentenced to prison last week, closing a chapter on a drug network that never got off the ground.
