ORLANDO, FL – Frank Richard Nickens, 58, of Arizona, will spend the next three years in federal prison after being sentenced today for a brazen wire fraud scheme that exploited the panic surrounding the early days of the COVID-19 pandemic. U.S. District Judge Paul G. Byron handed down the sentence, along with an order for Nickens to forfeit $69,155 – the ill-gotten gains from his deception – and pay full restitution to his victims.
The scam unfolded in April 2020, when hand sanitizer was a hot commodity and legitimate suppliers were struggling to keep up with demand. Nickens, then a resident of Ormond Beach, Florida, falsely presented himself as a large-scale producer of the crucial disinfectant. He pitched a story of massive production capacity, promising tens of thousands of units to three separate companies desperate to secure supply for their own customers.
These companies, operating in good faith, wired Nickens funds – a hefty 50% upfront deposit – believing they were securing a guaranteed supply. But Nickens had no manufacturing capability whatsoever. The entire operation was a calculated lie, a cynical play on fear and necessity. He pocketed the money, intending to vanish before anyone realized they’d been swindled.
Nickens pleaded guilty on March 3, 2025, admitting to the fraudulent scheme. The evidence, gathered by the Federal Bureau of Investigation, painted a clear picture of premeditation and greed. He wasn’t simply struggling to fulfill orders; he never intended to fulfill them at all. The investigation revealed a pattern of deceptive practices designed to capitalize on a public health crisis.
Assistant United States Attorney Michael P. Felicetta skillfully prosecuted the case, bringing Nickens to justice. The sentence sends a clear message: exploiting a pandemic for personal gain will not be tolerated. While three years is a start, the damage Nickens inflicted extends beyond the financial loss, contributing to the chaos and uncertainty of a frightening time.
The $69,155 forfeiture and ordered restitution represent a partial recovery for the victims.
