A Charleston man with a history of crime will face up to a decade in federal prison after pleading guilty to illegally possessing firearms, a crime he committed despite a prior felony conviction. Kerry A. Drake, 45, entered his plea in a federal courtroom on June 2, 2014.
The charges against Drake stem from a high-speed chase that took place in September of last year. Saint Albans police attempted a routine traffic stop, but Drake fled the scene, leading authorities on a wild goose chase through the streets of South Charleston. His vehicle ultimately malfunctioned, allowing police to apprehend him.
During the investigation, officers discovered a Bushmaster .223 rifle and an Ithaca shotgun in Drake’s car. Both guns were reported stolen by their rightful owners, adding another layer of severity to the crime.
Drake was not alone in the vehicle during the chase. Lucas Lynch, a passenger, jumped out of the moving car as Drake fled. Lynch is currently under indictment for being a felon in possession of a firearm and possession of a stolen firearm.
The investigation was led by the Saint Albans Police Department, with assistance from the federal Bureau of Alcohol, Tobacco, Firearms and Explosives. Assistant United States Attorneys Erik S. Goes and Jennifer Rada are handling the prosecution, which will be overseen by United States District Judge Thomas E. Johnston.
The case serves as a stark reminder of the dangers of firearms in the wrong hands. With a prior felony conviction, Drake should have been aware of the risks and consequences of possessing firearms. His actions have put the community at risk and will likely result in a lengthy prison sentence.
Drake’s sentencing is scheduled for June 2, 2014. At that time, he will face up to 10 years in federal prison for his crimes.
