Miami-Dade resident Wisly Toussaint was sentenced to 14 years in prison and ordered to pay $317,557 in restitution in a high-profile identity theft case. Toussaint, 36, was convicted of conspiracy to commit access device fraud, access device fraud, and aggravated identity theft in a five-day trial.
The evidence presented during the trial revealed that Toussaint possessed and trafficked in personal identifying information, which was stolen from a mental health facility in Philadelphia. The stolen information included names, dates of birth, and social security numbers.
Toussaint was approached by two individuals cooperating with law enforcement and agreed to sell the stolen information. He later sold the information to the cooperators in two separate meetings.
The case was investigated by the FBI, IRS-CI, and ICE-HSI, with assistance from law enforcement in Philadelphia. The U.S. Attorney’s Office for the Southern District of Florida prosecuted the case, led by Assistant U.S. Attorney Frank R. Maderal.
Toussaint’s crimes included conspiracy to commit access device fraud, access device fraud, and aggravated identity theft. He was found guilty of one count of conspiracy, two counts of access device fraud, and five counts of aggravated identity theft.
U.S. Attorney Wifredo A. Ferrer commended the investigative efforts of the agencies involved in the case. Ferrer praised the work of the FBI, IRS-CI, and ICE-HSI in bringing Toussaint to justice.
Toussaint’s sentence of 14 years in prison and three years of supervised release is a significant blow to those involved in identity theft schemes. The $317,557 in restitution ordered by the court will also help to compensate victims of the crime.
