Federal Agencies Delay CRA Rule Implementation, Washington D.C., 2024

Federal bank regulatory agencies today announced a significant move to delay the implementation of certain provisions within their Community Reinvestment Act (CRA) final rule, originally set to take effect on April 1, 2024.

In a joint release, the Board of Governors of the Federal Reserve System, the Federal Deposit Insurance Corporation (FDIC), and the Office of the Comptroller of the Currency (OCC) revealed that the applicability date for facility-based assessment areas and public file provisions has been extended to January 1, 2026. This change ensures a consistent implementation timeline with other key aspects of the CRA final rule, aligning all evaluations on the same date.

According to the agencies, this extension is intended to promote clarity and consistency in how banks manage their assessment areas and public files. Banks will not be required to make any changes to these areas or their public records until 2026, offering a reprieve from the immediate impacts of the October 2023 final rule.

In addition to the applicability date extension, the agencies also issued technical amendments to the CRA final rule and related regulations. One such amendment clarifies that banks do not need to update their public notices until January 1, 2026, further emphasizing the delay in regulatory requirements.

First enacted nearly 50 years ago, the CRA is designed to encourage banks to meet the credit needs of all communities, including low- and moderate-income neighborhoods. This recent move by federal agencies aims to ensure that banks have ample time to adapt to the new regulations, potentially reducing compliance costs and streamlining the process for institutions.

Comments on the extended applicability dates are now being accepted, with a deadline set 45 days after the rule is published in the Federal Register. The agencies encourage stakeholders to provide feedback on the implementation timeline and any potential challenges they may face.
