ATLANTA – Agility Public Warehousing Co. KSC (Agility), the Kuwaiti company, has caved in to a massive settlement after being accused of overcharging the United States government by hundreds of millions of dollars during its contracts with the Department of Defense (DOD) for feeding U.S. troops between 2003 and 2010.
The settlement includes paying $95 million to resolve civil fraud claims, waiving administrative claims worth an additional $249 million, and pleading guilty to a criminal misdemeanor charge for theft of government funds. The DLA has also lifted its suspension on Agility after being suspended from federal government contracting for the past seven years.
‘Today’s global resolution is a fair and just outcome for the cases that have been pending since 2009,’ said U.S. Attorney John Horn. ‘Agility admitted to criminal conduct, gave up their claims, and must pay back what was wrongly obtained from the government. These agreements demand Agility take responsibility for its actions and prevent recurrence while allowing the government to recover significant funds.’
‘The Department of Justice will hold contractors accountable who seek to profit unfairly at the expense of U.S. troops and taxpayers,’ added Deputy Assistant Attorney General Joyce R. Branda. ‘Government business must be conducted fairly and honestly, adhering to contract terms agreed upon.’
FBI Special Agent in Charge David J. LeValley commended the tenacity of investigators, law enforcement partners, and federal prosecutors who brought this investigation to a successful conclusion.
John F. Khin, Special Agent in Charge of DCIS-Southeast Field Office, highlighted the importance of protecting tax dollars spent on DoD programs and missions from fraud and abuse during overseas combat operations, especially when funds are most vulnerable. He praised the perseverance and dedication shown by DCIS agents and partners.
