Two Sentenced in $7 Million Loan Modification Scheme

Ontario, Canada resident Ajay Thuraisingham, 27, and Coconut Creek resident Christopher Duharte, 36, have been sentenced to prison for their roles in a $7 million loan modification scheme that targeted thousands of homeowners in Florida.

According to the indictment, between September 2008 and August 2009, Thuraisingham and Duharte operated boiler rooms that collected advance fees from distressed homeowners in exchange for obtaining loan modifications, which were rarely provided. The scheme, which involved 10 defendants, bilked over 2,000 homeowners out of more than $7 million.

Thuraisingham was sentenced to 54 months in prison, while Duharte received a 30-month sentence. Both defendants were also ordered to three years of supervised release and to pay restitution in an amount to be determined.

The scheme, which was operated by FHA All Day.com, Inc. and two other companies, involved false statements to homeowners, including claims that they had already been approved for loan modifications and that a team of ‘expert attorneys’ would finalize the modifications.

Thuraisingham and Duharte are the latest defendants to plead guilty in the case, with eight of the 10 defendants charged in the scheme having already entered guilty pleas. Jason Vitulano and Jeffrey Taylor are currently set for trial in November 2014.

The case was investigated by the U.S. Secret Service and the U.S. Postal Inspection Service, with assistance from the U.S. Attorney’s Office for the Southern District of Florida.
