Counterfeit Pet Products: Allen Smith Sentenced to 37 Months in Prison
An Arizona man, Allen Smith, 50, of Phoenix, has been sentenced to serve 37 months in prison for his involvement in a scheme to traffic pet products with counterfeit labels into the United States.
The U.S. Attorney’s Office for the Southern District of Texas announced the sentencing, which was handed down by U.S. District Judge David Hittner. In addition to the prison sentence, Smith has been ordered to pay $867,150 in restitution and forfeit $42,269 worth of illicit proceeds.
According to admissions made by Smith in connection with his plea, he was responsible for aiding and abetting the trafficking of over $1 million worth of veterinary products that were not manufactured for the U.S. market into the United States for distribution under false labels.
The counterfeit products included Merial Pharmaceutical Company-manufactured products such as Frontline and Frontline Plus, as well as Bayer-manufactured products like Advantage and K9 Advantix. Smith intentionally trafficked in these products to deceive retail stores and consumers into believing that they had received necessary Environmental Protection Agency (EPA) authorization to be manufactured and approved for sale in the United States.
The case was investigated by the FDA-OCI, Homeland Security Investigations, and the EPA, with significant assistance from the U.S. Attorney’s Office of the Central District of California and the Computer Crime and Intellectual Property Section’s Cybercrime Lab.
Assistant U.S. Attorney Jennifer Lowery and Assistant Deputy Chief John H. Zacharia are prosecuting the case. U.S. Attorney Kenneth Magidson and Acting Assistant Attorney General Kenneth A. Blanco also made statements regarding the sentencing.
