Amtex Systems Inc., a New York-based IT staffing and recruiting company, has agreed to settle claims of immigration bias in hiring practices, the US Department of Justice announced today.
The settlement resolves allegations that Amtex Systems discriminated against American employees in the hiring process based on their citizenship or immigration status, giving preference to candidates with temporary work visas.
According to the Department of Justice, the investigation began after a US citizen filed a complaint with the Civil Rights Division’s Immigrant and Employee Rights Section (IER) alleging that Amtex Systems discriminated against them in the hiring process.
As a result of the investigation, the Department of Justice found that Amtex Systems identified job applicants based on their clients’ preferences for candidates with specific citizenship or immigration status, and that the company implemented hiring practices that gave preference to candidates with temporary work visas over American employees.
The investigation also found that Amtex Systems required job applicants to provide regular documentation of their immigration status, a practice that is not required by law, and that the company failed to consider American employees for job openings.
Under the settlement, Amtex Systems will pay the United States $15,000 or more in civil penalties, revise its policies and procedures, provide training to its employees and agents on the anti-discrimination provisions of the Immigration and Nationality Act, and be subject to monitoring for three years to ensure compliance.
The Civil Rights Division’s Immigrant and Employee Rights Section is responsible for enforcing the anti-discrimination provisions of the Immigration and Nationality Act, which prohibits employment discrimination based on citizenship, immigration status, national origin, and other factors.
