Rochester, NY – A local property developer has been sentenced for knowingly exposing workers, including a minor, to dangerous levels of asbestos during illegal removal operations. Anastasios “Taso” Kolokouris, 32, of Avon, New York, received two years of probation, 150 hours of community service, and a $15,000 fine after pleading guilty to violating the Clean Air Act.
The case unfolded after a December 2011 inspection of a warehouse located at 920 Exchange Street in Rochester. A New York State Department of Labor inspector discovered individuals, including a 16-year-old, working within a dumpster filled with white fibrous material later confirmed to be asbestos. Crucially, workers lacked proper protective equipment, and no asbestos warning signs were present. When confronted, Kolokouris allegedly instructed the workers to avoid speaking with the inspector and immediately cease operations, attempting to conceal the illicit activity.
A subsequent federal search, conducted by agents from the U.S. Environmental Protection Agency (EPA) and the New York Department of Environmental Conservation (DEC), revealed a staggering amount of improperly handled asbestos. Over 90 bags of dry, friable asbestos were found inside the warehouse loading dock, with evidence indicating contamination across more than 150,000 square feet. The location’s proximity to residential homes and a school bus stop heightened the risk to the surrounding community.
Investigators determined that Kolokouris had hired workers, offering cash payments, to remove asbestos from the dumpster because a container company refused to handle the hazardous waste. These workers were not certified or trained in asbestos abatement, and Kolokouris allegedly transported the juvenile worker and his mother to the site, paying them to participate in the dangerous task. Instead of providing respirators or protective suits, workers were only given basic dust masks – a woefully inadequate defense against the deadly fibers.
Legal Ramifications
Kolokouris was found to have violated 42 U.S.C. 7413(c)(1) of the Clean Air Act, specifically pertaining to asbestos work practice standards. The Clean Air Act, enacted to protect and enhance the nation’s air quality, mandates strict regulations for handling and removing asbestos, a known carcinogen. The sentencing reflects the severity with which federal authorities view violations that endanger public health and safety. In addition to the financial penalties and community service, Kolokouris is also required to pay restitution to the victims impacted by his actions.
