Guatemalan Man Charged with Unlawful Re-Entry in Kansas
A Guatemalan man is facing federal charges after being found in Kansas less than four months after being deported.
Andres Marcelo De Leon-Perez, 25, was indicted on Wednesday on one count of unlawfully re-entering the United States.
According to court documents, De Leon-Perez was deported to Guatemala on December 27, 2018, and was found in Wyandotte County, Kansas, on April 11, 2019.
This is not the first time De Leon-Perez has been charged with unlawfully re-entering the country. In 2017, he was apprehended by the U.S. Border Patrol near Valentine, Texas, and was deported to Guatemala on January 22, 2018.
If convicted, De Leon-Perez faces a penalty of up to two years in federal prison and a fine of up to $250,000.
The case was investigated by Homeland Security Investigations, and Assistant U.S. Attorney Trent Krug is prosecuting the case.
In a separate incident, Jordy Ulises Cody-Lemus, 20, a citizen of Guatemala, was also charged with unlawfully re-entering the United States after being deported. He was found in Wyandotte County, Kansas, on April 11, 2019.
Both De Leon-Perez and Cody-Lemus are presumed innocent until proven guilty. The indictments only contain allegations of criminal conduct.
