Arizona’s child protection agency is facing allegations of disability discrimination, according to a recent investigation by the U.S. government.
El Departamento de Seguridad del Niño de Arizona (DCS) has been accused of violating the Americans with Disabilities Act (ADA) by denying effective communication and auxiliary aids to parents and children with disabilities, including deaf and hard-of-hearing individuals, as well as those with visual impairments and other disabilities.
The investigation, conducted by the U.S. Department of Justice, found that DCS failed to provide American Sign Language (ASL) interpreters to deaf and hard-of-hearing parents, caregivers, and children during critical meetings and when children were removed from their homes.
DCS also neglected to communicate with parents with disabilities in ways that they could understand, resulting in misunderstandings and confusion about their cases and interactions with the agency.
Furthermore, the investigation revealed that DCS refused to make reasonable accommodations for parents with disabilities, despite the fact that these accommodations could have helped address concerns raised by the agency.
The U.S. Department of Justice has provided DCS with a written letter outlining the necessary steps to address the identified violations and ensure compliance with the ADA.
According to the letter, DCS is required to take immediate action to provide effective communication and auxiliary aids to parents and children with disabilities, including the provision of ASL interpreters and other accommodations.
The investigation’s findings are a stark reminder of the ongoing struggles faced by individuals with disabilities in accessing basic services and rights.
The case highlights the need for greater accountability and reform within the child welfare system to ensure that families with disabilities receive the support and services they need to thrive.
