Letitia James Calls for Anti-Predatory Pricing Law, New York NY, 2024

New York Attorney General Letitia James has taken a bold stance against predatory pricing schemes by calling for the passage of the One Fair Price Package. This comprehensive legislative initiative aims to safeguard New Yorkers from unfair pricing practices, including surveillance pricing and electronic shelf labeling.

Joining forces with Senate Deputy Majority Leader Michael Gianaris, Senator Rachel May, Assemblymember Michaelle Solages, and Assemblymember Emérita Torres, Attorney General James also rallied with labor unions UFCW Local 1500 and RWDSU, as well as AARP New York. The One Fair Price Package is composed of two pivotal bills: The One Fair Price Act and the Protecting Consumers and Jobs from Discriminatory Pricing Act.

The One Fair Price Act, sponsored by Assemblymember Torres and Senator May, proposes a ban on surveillance pricing – where companies use personal data to set individualized prices. Senate Deputy Leader Gianaris and Assemblymember Solages’ Protecting Consumers and Jobs from Discriminatory Pricing Act further restricts the use of electronic shelf labels and bans surveillance pricing in grocery stores and pharmacies.

Attorney General James emphasized the importance of transparency, stating, “New Yorkers should be able to trust that they are seeing the same prices as everyone else, not an individualized price set by an algorithm.” She expressed her gratitude to the legislative sponsors for their commitment to consumer protection.

Senate Deputy Leader Gianaris echoed these sentiments, pointing out the misuse of personal data by corporations and emphasizing the need to protect consumers from such predatory practices. Senator May emphasized the necessity of preventing companies from using data to maximize individual prices, while Assemblymember Torres highlighted the importance of transparency in the digital marketplace.

Assemblymember Solages voiced concerns about companies exploiting consumer information for financial gain, noting that this systematic overcharging can lead to discrimination. The One Fair Price Package represents a significant step towards ensuring fairness and transparency in New York’s consumer market.
