New York – The aggressive stance of New York Attorney General Letitia James has yielded a landmark victory for student athletes. AG James, along with a coalition of state attorneys general, secured a settlement with the National Collegiate Athletic Association (NCAA) that ends restrictions on students’ ability to profit from their own brand.
In May 2024, the lawsuit filed by Attorney General James and her coalition targeted the NCAA’s NIL (Name, Image, and Likeness) rules, which they argued unfairly limited student athletes’ potential earnings. The lawsuit claimed these regulations were in violation of federal antitrust law and hindered students’ ability to make informed decisions about their academic and athletic futures.
“Student athletes should have the freedom to decide their athletic careers without artificial barriers,” said Attorney General James. “The NCAA’s NIL rules created an uneven playing field, stripping these young talents of potential income before they even committed to a school.”
The lawsuit was successful in securing a federal judge’s decision to block enforcement of the NCAA’s restrictive NIL rules. This victory paved the way for negotiations that resulted in a comprehensive settlement. The NCAA will no longer enforce its NIL recruiting rules, and any new proposals related to NIL opportunities must be publicly disclosed on a dedicated webpage for five years.
Joining Attorney General James were attorneys general from Florida, Tennessee, Virginia, and the District of Columbia, all committed to this groundbreaking legal victory. The Antitrust Bureau, led by Senior Enforcement Counsel Bryan Bloom, Deputy Bureau Chief Amy McFarlane, and Bureau Chief Elinor Hoffmann, played a crucial role in achieving this outcome.
This landmark settlement signifies a significant win for student athletes across the nation, ensuring their rights are protected and that they can fully benefit from their hard-earned talents.
