James Hocker, a 49-year-old insurance agent from Bellefonte, Pennsylvania, was sentenced to 204 months—17 years—in federal prison for running a multi-million-dollar securities fraud scheme that preyed on the trust and retirement savings of dozens of elderly victims.
Hocker was sentenced on April 26, 2019, by United States District Court Judge Matthew W. Brann, who also imposed three years of supervised release and ordered restitution of $1,495,782.62 to the 38 defrauded investors. Instead of investing their money as promised, Hocker funneled the cash into personal expenses, shattering the financial stability of retirees who believed they were securing their futures.
According to U.S. Attorney David J. Freed, Hocker lured victims between 2009 and 2018 with promises of guaranteed returns as high as 30%. He exploited his position as a licensed insurance agent to gain credibility, convincing investors to liquidate retirement accounts and cash out insurance policies to fund his fictitious investment ventures.
The scheme unraveled as victims began demanding returns that never came. Many lost their life savings, with some forced to downsize homes or delay medical care after handing over their financial futures to a man they believed was acting in their best interest.
The investigation was led by the U.S. Securities and Exchange Commission’s Enforcement Division and the Federal Bureau of Investigation, a rare joint effort underscoring the brazen nature of Hocker’s deception. Evidence showed a pattern of manipulation, forged documents, and a complete absence of legitimate investment activity.
Assistant United States Attorney Alisan V. Martin prosecuted the case, calling Hocker’s actions a betrayal of public trust and a textbook example of financial predation. The 17-year sentence reflects the severity of the crime and sends a message that exploiting vulnerable investors will be met with maximum consequences under federal law.
