Ben Broyles, Septic Waste Dumping, Idaho 2016

HAYDEN, ID – Ben Broyles, 62, owner and operator of The Rooter Guy, LLC, was sentenced to three years of probation on February 2, 2016, for illegally dumping septic waste into the City of Hayden’s municipal sewer system. The Rooter Guy, LLC, also received three years of organizational probation, following guilty pleas entered on November 18, 2015, in U.S. District Court.

According to court documents, between March 17, 2014, and May 16, 2014, Broyles and his company knowingly violated federal regulations by bypassing permitted septic waste disposal facilities. While licensed to collect septic waste from both residential and commercial properties, The Rooter Guy, LLC was required to transport and deposit the waste at designated treatment plants capable of handling its specific composition. Instead, the company illegally discharged the waste into the Hayden Area Regional Sewer Board’s system, which is not equipped to process such materials.

The illicit dumping caused potential damage to the city’s sewer infrastructure and posed a significant risk to public health. Officials warn that untreated septic waste can contain harmful pathogens and contaminants, potentially sickening residents or damaging the delicate balance of the local ecosystem. The Environmental Protection Agency (EPA) spearheaded the investigation, with support from multiple agencies including the Federal Bureau of Investigation, U.S. Forest Service, U.S. Secret Service, and the Kootenai County Sheriff’s Office.

Financial Penalties and Community Service

Chief U.S. District Judge B. Lynn Winmill ordered Broyles and The Rooter Guy, LLC, to pay a combined $17,000 in fines and $4,000 in restitution to the City of Hayden for damages and costs incurred as a result of the illegal dumping. Additionally, Broyles was mandated to complete 100 hours of community service. U.S. Attorney Wendy J. Olson emphasized that the prosecution sends a strong message that businesses prioritizing profits over public safety will face consequences.

EPA and DOJ Response

“Enforcement of federal criminal environmental laws promotes healthy safe communities for all of us,” stated U.S. Attorney Olson. “Unfortunately, The Rooter Guy LLC put its bottom line above its obligation to conduct its business in a way that protects public safety.” Scot Adair, Acting Special Agent in Charge of EPA’s criminal enforcement program in Idaho, added, “Dumping unpermitted septic waste into a wastewater treatment plant not only damages expensive equipment, but can sicken or injure people…Today’s guilty plea shows that those who ignore this country’s environmental laws can expect to face the consequences in court.”
