Benjamin Wayne Hyre, Felon in Possession of a Firearm, West Virginia 2016

A Petersburg man is facing the consequences of his actions after being convicted of a firearm charge. Benjamin Wayne Hyre, 37, pled guilty to one count of Felon in Possession of a Firearm in a Grant County court.

The crime occurred in March 2016, when Hyre, a two-time convicted felon, was found to be in possession of a .22-250 caliber rifle. His previous convictions were also in Grant County Circuit Court.

Assistant U.S. Attorney Stephen D. Warner is prosecuting the case on behalf of the government. The Bureau of Alcohol, Tobacco, Firearms and Explosives and the Grant County Sheriff’s Office investigated the crime.

According to the charges, Hyre faces up to 10 years in prison and a fine of up to $250,000. His actual sentence will be determined by the seriousness of the offenses and his prior criminal history, if any.

The case was presided over by U.S. Magistrate Judge Michael John Aloi. Acting United States Attorney Betsy Steinfeld Jividen announced the conviction.
