Birmingham, AL – In a shocking display of disregard for the law, Lusion Joshua Rice, 31, was sentenced to 15 years in prison for being a felon in possession of a firearm. The sentence was handed down by U.S. District Judge R. David Proctor.
A federal grand jury in the Northern District of Alabama charged Rice with possession of a firearm after having been convicted of violent felony offenses, including three crimes that qualified him for an enhanced sentence under the Armed Career Criminal Act (ACCA).
The charges stem from an incident in April 2016 when Birmingham police officers responded to a call about a domestic disturbance at a home. Upon arrival, officers found Rice holding a beer in one hand and a shotgun in the other. He was immediately placed under arrest.
The investigation was a joint effort between the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and the Birmingham Police Department. ATF’s priority is to provide a safe environment for the public, as stated by Steven Gerido, Special Agent in Charge.
Assistant United States Attorney Gregory R. Dimler prosecuted the case on behalf of the United States.
