Brian Foster, 2nd Degree Murder, District of Columbia 2022

A Southeast Washington man has been sentenced to 14 years in prison for a 2021 shooting that left one man dead.

According to court records, 40-year-old Brian Foster was sentenced on [date] for the second-degree murder of Anthony Mitchell, 44, who was shot twice in his car on August 18, 2021. The shots hit Mitchell in the left side of his face and in his left arm, left lung, and spine, killing him.

Foster pleaded guilty in August 2022 to the crime, which was contingent upon the court’s approval. The plea agreement called for an agreed-upon sentence of 14 years in prison.

Following his prison term, Foster will be placed on five years of supervised release.

The investigation revealed that Foster and two friends got into a nearby car and started smoking marijuana and PCP while listening to music. After about eight minutes, Foster got out of the car, walked over to where Mitchell sat in his car, pulled out a handgun, and shot Mitchell twice through the closed door of his car.

Foster was arrested on October 26, 2021, and has been in custody ever since. In announcing the sentence, U.S. Attorney Matthew M. Graves and Chief of the Metropolitan Police Department Robert J. Contee commended the work of those who investigated the case, including the Criminal Investigations Division Homicide Branch of the MPD.

Foster, 40, of Washington, D.C., was sentenced by The Honorable Rainey R. Brandt in the Superior Court of the District of Columbia.
