Matthew Jaskula, Willful Deprivation of Constitutional Rights, New York 2016

Acting U.S. Attorney James P. Kennedy, Jr. announced that Matthew Jaskula, 27, of Buffalo, NY, pleaded guilty to a one-count indictment against him for willfully depriving another of their constitutional rights under color of law resulting in bodily injury. The charge carries a maximum penalty of 10 years in prison and a $250,000 fine.

Jaskula worked as a Cell Block Attendant with the Buffalo Police Department since 2013 when he committed the offense on May 19, 2016. During an incident at the cell block area of police headquarters, Jaskula is accused of grabbing the victim from behind and shoving him face-first into a door, causing severe injuries.

The victim was then dragged by his handcuffed arms, resulting in further injury. Jaskula failed to seek medical attention for the facial injuries and left the victim in a restraint chair for approximately an hour and 45 minutes. The incident was captured on video.

Jaskula’s actions led to the victim being taken to Erie County Medical Center for treatment of nasal bone fractures and a laceration between his nose and right eye. Sentencing is scheduled for October 12, 2017.

The investigation into this case was conducted by the Federal Bureau of Investigation and the Buffalo Police Department under Special Agent in Charge Adam S. Cohen and Commissioner Daniel Derenda.
