Buffalo’s Damian Hicks-Bailey, 22, has entered a guilty plea for selling heroin, an act directly tied to a fatal overdose. The plea comes before U.S. District Judge Richard J. Arcara and carries a possible sentence of up to 20 years in prison and a $1,000,000 fine.
The grim revelation unfolded when the West Seneca Police Department responded to a harrowing 911 call reporting a dead son. The scene at 4175 Seneca Street revealed an uncapped syringe, a spoon with drug residue, and Hicks-Bailey’s DNA in an empty plastic bag. Text messages on the victim’s phone implicated Hicks-Bailey as the supplier.
Assistant U.S. Attorney Michael P. Felicetta handled the case, which was investigated by the Drug Enforcement Administration and the West Seneca Police Department. Sentencing is set for August 12, 2017.
Hicks-Bailey’s arrest follows a thorough investigation led by Special Agent in Charge James J. Hunt of the DEA New York Field Division and Chief Daniel Denz of the West Seneca Police Department.
