Jose Cisneros, Possession of Child Pornography, New York 2016

Jose Cisneros, 31, of Blasdell, NY, pleaded guilty to possession of child pornography in federal court, admitting to exchanging graphic sexual images with a 13-year-old girl through the Kik messaging app and text messages.

The charge, announced by U.S. Attorney William J. Hochul, Jr., carries a maximum sentence of 10 years in prison and a fine of $250,000. Cisneros entered his plea before U.S. District Judge Richard J. Arcara, who will sentence him on February 10, 2016, at 1:30 p.m.

According to Assistant U.S. Attorney Aaron J. Mango, the Blasdell Police Department tipped off the FBI in August 2015 after discovering the minor, referred to as victim 1, engaged in sexually explicit conversations with Cisneros. The exchange included explicit photos transmitted between the defendant and the child.

The investigation intensified when the mother of Cisneros’s two children told FBI agents she discovered a phone belonging to him containing a sexual text conversation. She confronted Cisneros, sparking a heated argument that prompted a police response to the residence.

The case was led by agents from the Federal Bureau of Investigation under the direction of Adam S. Cohen. Digital forensics tied Cisneros directly to the illicit messages and images, forming the backbone of the prosecution’s evidence.

No additional charges were filed at this time, but authorities warn the public about the dangers of predatory behavior on social media platforms. Cisneros remains in custody pending sentencing.
