A 34-year-old Cheektowaga man, Robert Acker, has been charged with possession of child pornography depicting minors less than 12 years of age. The charge carries a maximum penalty of 20 years in prison and a fine of $250,000.
According to U.S. Attorney William J. Hochul Jr., the charge was announced after a thorough investigation by the Federal Bureau of Investigation. Assistant U.S. Attorney Scott S. Allen, Jr., who is handling the case, stated that the complaint revealed Acker was in possession of more than 7,000 images of child pornography.
The investigation began on September 1, 2016, when the Federal Bureau of Investigation executed a search warrant at Acker’s residence. Several electronic devices and DVDs were seized during the search, which were later examined by forensic experts. The examination revealed the presence of child pornography, including images of prepubescent children less than 12 years of age.
Acker made an initial appearance before U.S. Magistrate Judge H. Kenneth Schroeder, Jr., and was ordered to abide by the conditions of the Home Confinement Program. This requires that he be electronically monitored at all times. The criminal complaint is the result of an investigation by the Federal Bureau of Investigation, Violent Crimes Against Children program, under the direction of Special Agent in Charge Adam S. Cohen.
The fact that a defendant has been charged with a crime is merely an accusation, and the defendant is presumed innocent until and unless proven guilty. As the case progresses, more information will become available. For now, Acker remains under home confinement, awaiting further proceedings.
