BUFFALO, N.Y. – Joshua Butler, a 42-year-old resident of Buffalo, NY, has pleaded guilty to possession of child pornography, according to Acting U.S. Attorney James P. Kennedy, Jr. The disturbing charges come as the result of a thorough investigation by the Federal Bureau of Investigation and Immigration and Customs Enforcement.
Butler’s guilty plea marks a continuation of his troubled legal history. In April 2016, he was convicted in state court for promoting a sexual performance by a child, leading to a 10-year probation sentence. However, on July 19, 2016, an Erie County Probation Officer discovered two cellular phones at Butler’s residence that were against his parole conditions. A forensic examination of these devices revealed over 300 images of child pornography, including graphic content involving children under the age of 12.
The FBI and ICE conducted the investigation that led to Butler’s conviction. Sentencing is set for June 13, 2017, before U.S. District Judge Lawrence J. Vilardo, who will determine the maximum penalty of 20 years in prison and a $250,000 fine for this heinous crime.
