California Man Indicted for Marijuana Sales and Gun Charge

A Tracy, California man has been indicted for selling marijuana in Rapid City and possessing a firearm with an obliterated serial number, according to United States Attorney Brendan V. Johnson.

Troy Leroy James, age 47, was indicted on January 23, 2013 for Possession With Intent to Distribute a Controlled Substance and Possession of a Firearm with Obliterated Serial Number, a crime that carries a maximum penalty of 10 years’ imprisonment and/or a $250,000 fine.

James appeared before U.S. Magistrate Judge Veronica L. Duffy on January 31, 2013 and pled not guilty to the indictment. The charges are merely an accusation and James is presumed innocent until and unless proven guilty.

The investigation is being conducted by the Drug Enforcement Administration, the Bureau of Alcohol, Tobacco, Firearms, and Explosives, and the Unified Narcotics Enforcement Team. Assistant U.S. Attorney Eric Kelderman is prosecuting the case.

James was remanded to the custody of the U.S. Marshal. A trial date has not been set.
