A Monroe County man has pleaded guilty to filing false documents with the Department of Labor and the Internal Revenue Service. Charles A. Poalillo, Jr., 80, of Monroe County, Pennsylvania, made the admission on September 26, 2013.
Poalillo, the former owner of Penn Hills Lodge, Inc., a Pocono honeymoon resort in Analomink, Pennsylvania, was accused of falsely reporting the security of approximately $1 million borrowed from two pension funds. The funds were used to support Poalillo’s business ventures.
The United States Attorney’s Office for the Middle District of Pennsylvania announced the guilty plea. According to United States Attorney Peter J. Smith, Poalillo’s actions were a serious offense against the public trust.
Pursuant to a guilty plea agreement, Poalillo agreed to attempt to make full restitution by the time of sentencing. The exact amount of restitution has yet to be determined.
Poalillo’s guilty plea was accepted by Senior U.S. District Court Judge Edwin Kosik. The investigation into Poalillo’s activities was conducted by the United States Department of Labor’s Employee Benefits Security Administration and the Department of Labor’s Office of Inspector General, Office of Labor Racketeering and Fraud Investigations. The Monroe County District Attorney’s Office initiated the investigation and assisted the federal authorities.
The prosecution is assigned to Assistant United States Attorney Michael A. Consiglio. A sentence following a finding of guilty is imposed by the Judge after consideration of the applicable federal sentencing statutes and the Federal Sentencing Guidelines.
