Marlin Webb, Conspiracy to Defraud FDA, Virginia 2024

ABINGDON, VA – A Carroll County man is facing federal time after admitting to a scheme that put the public food supply at risk. Marlin Webb, 58, of Woodlawn, Virginia, pled guilty today in the United States District Court for the Western District of Virginia to one count of conspiracy to defraud the Food and Drug Administration (FDA). The former store manager at the Carroll County Cooperative illegally obtained, stored, sold, and shipped veterinary prescription drugs, bypassing crucial safety protocols.

Webb waived his right to an indictment and entered the guilty plea before the court. According to evidence presented by Assistant United States Attorney Randy Ramseyer, Webb operated outside the legal chain of distribution for these drugs. While the regulations aren’t necessarily about protecting the animals themselves, they’re about preventing dangerous drug residues from entering the human food supply. This isn’t about animal welfare; it’s about the meat on your plate.

“Law Enforcement will continue to be vigilant in ensuring all substances sold are done legally and in-line with FDA standards,” stated United States Attorney John P. Fishwick Jr. in a press release. The statement rings hollow to some, given the brazen nature of the operation and the potential consequences had it gone undetected longer. The feds are calling it a win, but the question remains: how widespread was this illegal activity?

Mark A. McCormack, Special Agent in Charge of the FDA Office of Criminal Investigations’ Metro Washington Field Office, emphasized the public health risk. “To protect the public…individuals attempting to circumvent these protections risk harming the public health,” McCormack stated. The FDA’s involvement underscores the severity of the offense, treating it as more than just a simple regulatory violation.

As part of a plea agreement, Webb has already shelled out $125,000 in forfeiture and other payments. However, that’s likely a small price to pay compared to what could come next. Webb is scheduled to be sentenced on March 30 at 11:00 a.m. in Abingdon. He faces a maximum of five years in prison and a $250,000 fine. Whether that’s enough to deter others from similar schemes remains to be seen.

The investigation was a joint effort between the FDA – Office of Criminal Investigations and the Virginia Department of Health Professions.
