Claremore Man Sentenced for Sexual Abuse of an Incapable Victim

TULSA, Okla. – A 47-year-old Claremore man has been sentenced for sexually abusing an incapable victim in Indian Country.

Cody Paul Miller, a citizen of the Cherokee Nation, was found guilty by a Federal jury in January and sentenced to 138 months imprisonment, followed by five years of supervised release. Upon his release, he will also be required to register as a sex offender.

The victim, an 18-year-old, spent the night at Miller’s house with two underage friends in July 2023. The victim testified that she woke up to Miller sexually assaulting her, despite her repeated requests to stop.

Miller initially claimed that the victim was consensually involved and that he stopped when she asked him to. However, the victim’s testimony contradicted Miller’s account, and he was subsequently found guilty of the charges.

The FBI and Collinsville Police Department investigated the case, and Assistant U.S. Attorneys Valeria G. Luster and Matthew P. Cyran prosecuted the case. Miller is currently in custody pending transfer to the U.S. Bureau of Prisons.
