FIREARM VIOLATIONS ROCK EAGLE BUTTE, SOUTH DAKOTA
Two Eagle Butte men have been slapped with serious firearm violations that could land them up to 10 years in prison and a hefty fine. Colten Walker Dolphus, 30, and Elliot Tiger, 27, have been charged with Unlawful Possession of Firearms and Ammunition, a crime that poses a significant threat to public safety.
According to sources, Dolphus and Tiger were indicted by a federal grand jury on June 14, 2017, for receiving and possessing firearms that had been shipped and transported in interstate and foreign commerce. The charges stem from a December 9, 2016 incident where the duo allegedly received the firearms despite Dolphus having a previous conviction for a misdemeanor crime of domestic violence and both being users of, and addicted to, a controlled substance.
The maximum penalty upon conviction for each individual is up to 10 years in custody and/or a $250,000 fine, 3 years of supervised release, forfeiture of the firearms and ammunition, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
Both Dolphus and Tiger pleaded not guilty to the indictment and were released on bond pending trial. Their trial is scheduled for August 22, 2017.
The case is being investigated by the Cheyenne River Sioux Tribe Law Enforcement Services Narcotics Division, with Assistant U.S. Attorney SaraBeth Donovan leading the prosecution.
The charges against Dolphus and Tiger are merely accusations, and they are presumed innocent until proven guilty. The community is left wondering how these individuals managed to possess firearms despite their troubled pasts.
