OAKLAND, CA – Javier Antonio Ramirez, 28, of Concord, California, is facing federal charges after investigators uncovered a trove of child pornography on his phone while investigating a near-fatal fentanyl overdose of a teenage girl. The United States Attorney’s Office for the Northern District of California and Homeland Security Investigations (HSI) announced Ramirez’s initial appearance in court today.
The case began unfolding in January 2023 when a Contra Costa County school nurse frantically administered multiple doses of Narcan to “Minor Victim 1” after she reportedly overdosed on fentanyl. First responders revived the girl, and she was rushed to a local hospital. The investigation quickly zeroed in on Ramirez, who authorities allege provided the fentanyl and even transported the minor to San Francisco to obtain the deadly drug.
But the investigation didn’t stop there. A search of Ramirez’s cell phone revealed a disturbing pattern of exploitation. Law enforcement discovered multiple videos and images depicting Ramirez engaging in sexually explicit conduct with a minor. Further digging unearthed a cache of child pornography files, including a nine-minute video from January 3, 2023, showing a child, estimated to be between 6 and 8 years old, being sexually exploited by an unidentified male. The details are grim and paint a picture of calculated predation.
Ramirez is currently charged with receipt of child pornography, a violation of 18 U.S.C. § 2252(a)(2). He remains in federal custody, awaiting a detention hearing scheduled for February 16, 2023, at 10:30 a.m. before U.S. Magistrate Judge Donna M. Ryu. The prosecution team, led by Assistant U.S. Attorney Kelly Volkar, with assistance from Leeya Kekona, is building a case that will hopefully bring justice to the victims.
If convicted, Ramirez faces a mandatory minimum sentence of 5 years in federal prison, with a potential maximum sentence of 20 years. Beyond imprisonment, he could also be subjected to supervised release, restitution orders, and significant financial penalties. However, the final sentence will be determined by the court, taking into account U.S. Sentencing Guidelines and federal sentencing laws (18 U.S.C. § 3553).
This investigation was a collaborative effort between Homeland Security Investigations and the Contra Costa Sheriff’s Office. It’s a stark reminder that the opioid crisis and the exploitation of children are often intertwined, and that law enforcement agencies are working tirelessly to dismantle these criminal networks. A complaint alleges these crimes; Ramirez is presumed innocent until proven guilty beyond a reasonable doubt.
