Convicted Felon Caught with Firearm

A Charleston man has been convicted of a federal gun crime following a jury trial. Michael Matthew Phillips, 31, was found guilty of possessing a firearm by a prohibited person.

According to court documents, Phillips was involved in a sting operation on January 24, 2017. He was supposed to sell heroin and a firearm to a confidential informant but failed to bring the heroin due to concerns of police presence. However, he did sell a 9mm handgun hidden in an area for $140.

Phillips, a convicted felon, is prohibited from possessing firearms. The incident puts public safety at risk, and the sale of firearms to those who are not supposed to have them is a serious matter, said United States Attorney Mike Stuart.

Stuart commended the work of the ATF, the Kanawha County Sheriff’s Department, and Assistant United States Attorney Greg McVey. ‘It’s simple – convicted felons are prohibited from possessing firearms,’ he said.

Phillips faces up to 10 years in prison and up to a $250,000 fine when he is sentenced in January 2019.
