A Dupree, South Dakota man was sentenced to 24 months in custody for his role in a violent assault in Eagle Butte.
On March 23, 2015, U.S. District Judge Roberto A. Lange handed down the sentence to 26-year-old Todd Johns, who was found guilty of Assault with a Dangerous Weapon and Aiding and Abetting.
Johns was one of three individuals who allegedly assaulted a victim with shod feet, metal crutches, and wooden clubs in July 2014, with the intent to do bodily harm.
The conviction arose from a federal indictment filed against Johns on September 16, 2014, for Assault with a Dangerous Weapon and Assault Resulting in Serious Bodily Injury. Johns pleaded guilty to the Assault with a Dangerous Weapon and Aiding and Abetting charge on January 6, 2015.
The case was investigated by the Cheyenne River Sioux Tribe Law Enforcement Division, with Assistant U.S. Attorney Mikal Hanson prosecuting the case.
As part of the sentence, Johns was also ordered to pay a $100 special assessment to the Federal Crime Victims Fund and serve 2 years of supervised release after his prison term.
Johns was immediately turned over to the custody of the U.S. Marshals Service to begin serving his 24-month sentence.
This case highlights the seriousness of violent crime in rural areas and the need for law enforcement to take a proactive approach in investigating and prosecuting such cases.
