EAST CHICAGO, IN – Darius Dudley, 30, of Chicago, Illinois, is headed to federal prison for 37 months after pleading guilty to being a felon in possession of a firearm – a firearm that had been illegally modified to function as a machinegun. U.S. District Court Judge Jon E. DeGuilio handed down the sentence Thursday, adding two years of supervised release to Dudley’s term.
The case unfolded last July when East Chicago Police responded to reports of shots fired in the 4800 block of Northcote Avenue. Officers found Dudley clutching a semi-automatic pistol equipped with an extended magazine and, critically, a device that converted it into a fully automatic weapon. With a single pull of the trigger, the modified pistol could unleash a rapid succession of rounds, turning a handgun into a dangerous instrument of escalating violence.
Federal prosecutors weren’t dealing with a first-time offender. Dudley already had a rap sheet, including prior felony convictions for burglary, manufacture/delivery of a controlled substance, and a previous charge of being a felon in possession of a firearm. That history automatically disqualified him from legally owning any weapon, making his possession of the modified pistol a clear violation of federal law.
The investigation was a joint effort between the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) Indiana High Intensity Drug Trafficking Task Force and the East Chicago Police Department. Assistant U.S. Attorney Michael J. Toth led the prosecution, building a case that highlighted the danger posed by illegally modified firearms and the importance of keeping them out of the hands of convicted felons.
Federal officials framed the sentencing as part of “Project Safe Neighborhoods” (PSN), a broad initiative aimed at reducing violent crime and gun violence by fostering collaboration between law enforcement and communities. The Department of Justice launched a renewed focus on PSN in May 2021, emphasizing community trust, prevention programs, strategic enforcement, and measurable results. But for residents of East Chicago, the case serves as a stark reminder of the ongoing battle against illegal weapons and the individuals who put public safety at risk.
Dudley’s 37-month sentence sends a message, though whether it’s enough to deter others remains to be seen.
