Defendant Charged with Child Pornography Offenses

KANSAS CITY, Mo. – Dennis Adlai Hernandez, a 28-year-old elementary school teacher from Independence, Mo., has been charged with child pornography offenses in federal court.

Hernandez was arrested at his home yesterday during the execution of a federal search warrant. He remains in custody and is scheduled for his initial appearance today before a federal magistrate.

The charges against Hernandez include transportation of child pornography, production and attempted production of child pornography, and possession of child pornography. Under federal statutes, the minimum sentence for transportation of child pornography is 5 years, while the maximum sentence is 20 years. Production and attempted production of child pornography carries a minimum sentence of 15 years and a maximum sentence of 30 years. The maximum statutory sentence for possession of child pornography is 20 years.

The charges contained in this complaint are simply accusations and not evidence of guilt. Evidence supporting the charges must be presented to a federal trial jury, whose duty is to determine guilt or innocence.

This case is being prosecuted by Assistant U.S. Attorney Alison Dunning. The investigation was led by the Federal Bureau of Investigations as part of Project Safe Childhood, a nationwide initiative launched in May 2006 to combat the growing epidemic of child sexual exploitation and abuse.

Project Safe Childhood marshals federal, state, and local resources to locate, apprehend, and prosecute individuals who sexually exploit children, and to identify and rescue victims.
