Defendant’s Despicable Crime Exposed: $29,510 Tax Loss to the U.S. Treasury
According to a civil suit filed in the Eastern District of Texas, the United States has taken action against Desmond I. Chizoba, a notorious tax return preparer who has been operating under the names Liberty Tax Service and Kish Tax Service. The complaint seeks to bar Chizoba from owning or operating a tax return preparation business and preparing tax returns for others.
The government’s complaint alleges that Chizoba prepares returns claiming false credits and fabricated businesses, related losses, and itemized deductions. For example, the government alleges that Chizoba prepared a return on which he concocted a business for a health insurance industry employee and fabricated a $29,510 loss for the phony business.
“Particularly during this time of year, when honest taxpayers are filing their returns, we want the public to know that the Justice will pursue those who would abuse our nation’s tax laws,” said Principal Deputy Assistant Attorney General for the Tax Richard Zuckerman. “Fraudulent tax return preparers too often seek to take advantage of their customers and the U.S. Treasury, which undermines our tax system.”
Return preparer fraud is one of the IRS’s Dirty Dozen Tax Scams and taxpayers seeking a return preparer should remain vigilant. The IRS has information on its website for choosing a tax preparer and has launched a free directory of federal tax preparers.
In the past decade, the Tax Division has obtained injunctions against hundreds of unscrupulous tax preparers. Information about these cases is available on the Justice website. An alphabetical listing of persons enjoined from preparing returns and promoting tax schemes can be found on this page. If you believe that one of the enjoined persons or businesses may be violating an injunction, please contact the Tax Division with details.
The Tax Division has made it clear that it will not tolerate tax return preparers who engage in this type of despicable behavior. Chizoba’s actions have caused the United States to lose substantial tax revenue, and he will now face the consequences for his crimes.
Taxpayers are advised to be cautious when choosing a tax return preparer and to do their research before giving anyone access to their financial information.
