Two brothers from New Orleans are facing severe consequences for their alleged roles in a deadly crime.
Don Brooks, age 19, and Antoine Brooks, age 21, were charged in a 9-count superseding indictment for their involvement in a drug trafficking operation and the murder of Tamira Johnson.
The superseding indictment, announced by U.S. Attorney Dana J. Boente, includes charges of conspiracy to possess with the intent to distribute 280 grams or more of cocaine base, conspiracy to use and discharge firearms in furtherance of crimes of violence and drug trafficking crimes, discharging a firearm in furtherance of a drug trafficking crime, and the murder of Harry Howard and Lamont Phillips.
According to the indictment, on September 23, 2011, Don and Antoine Brooks opened fire with a .40 caliber handgun, intending to kill a rival drug dealer, but ended up shooting and killing Tamira Johnson, who was walking to the store with her 13-year-old son.
If convicted of the new charges, Don and Antoine Brooks face a minimum term of imprisonment of five years and a maximum term of life imprisonment, as well as a $250,000 fine. The penalties for the original charges remain the same.
The case was investigated by the Drug Enforcement Administration and the New Orleans Police Department, and is being prosecuted by Assistant U.S. Attorney Sean Toomey.
U.S. Attorney Boente emphasized that the superseding indictment is merely a charge and that the guilt of the defendants must be proven beyond a reasonable doubt.
The defendants’ next court appearance has not been scheduled.
