Patrick Duran, Infant Assault, New Mexico 2014

Patrick Duran, 31, of Dulce, N.M., pleaded guilty on Aug. 19 to the heinous crime of assaulting an infant in Indian Country, resulting in serious bodily injury.

The Albuquerque federal court heard that Duran lost his temper while babysitting on the Jicarilla Apache Indian Reservation in Rio Arriba County, New Mexico, in September 2014. He picked up the 8-month-old baby from its crib and bit the child on the arm, unleashing a horror that would leave the infant with life-altering injuries.

The baby’s mother returned home to find her child unresponsive, both eyes fixed in one direction. The emergency was called, and the baby was rushed to a Farmington hospital, where doctors ordered an immediate flight to Albuquerque for further treatment. The child suffered bleeding to the brain and eyes, as well as seizures, due to Duran’s brutal act.

Patrick Duran is a non-Indian who stands to face up to seven years in prison following his plea agreement. He remains out of custody ahead of sentencing on Nov. 30.

The investigation was led by the Farmington office of the FBI and the Jicarilla Apache Police Department. Assistant U.S. Attorneys Kyle Nayback and Nicholas Marshall are prosecuting this case, ensuring justice for the innocent baby who survived Duran’s assault.

Both parents of the child are members of the Jicarilla Apache Nation, making the baby eligible to register with the tribe.
