Eagle Butte man, Kenny Fiddler, has been charged with Assault with a Dangerous Weapon after a federal grand jury indicted him on December 9, 2014. The 34-year-old appeared before U.S. Magistrate Judge Mark A. Moreno on January 15, 2015, and pled not guilty to the Indictment.
The maximum penalty upon conviction is up to 10 years in custody and/or a $250,000 fine, 3 years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The Indictment alleges that on or about August 23, 2014, Fiddler unlawfully assaulted a male victim with a knife with the intent to do bodily harm. The charge is merely an accusation and Fiddler is presumed innocent until and unless proven guilty.
The investigation is being conducted by the Cheyenne River Sioux Tribe Law Enforcement Services. Assistant U.S. Attorney Mikal Hanson is prosecuting the case.
Fiddler was remanded to the custody of the U.S. Marshals Service pending trial, which has been set for February 24, 2015. During the trial, Fiddler will face the allegations made against him and the consequences of his actions if found guilty.
