Edwin Gamboa-Reyes, Illegal Entry of a Removed Alien, Louisiana 2016

Edwin Gamboa-Reyes, a 25-year-old citizen of Mexico, was sentenced today on federal charges for illegally re-entering the United States after prior removal, a crime that carries stiff penalties under U.S. immigration law. The conviction stems from his apprehension by law enforcement in Hammond, Louisiana, on June 6, 2016, marking a repeat offense for the defendant.

Gamboa-Reyes previously pleaded guilty to a one-count Indictment charging him with illegal entry of a removed alien, in violation of Title 18, United States Code, Section 1326(a). The charge, a felony, reflects the federal government’s aggressive stance on immigration violations, particularly when individuals return after formal deportation.

U.S. District Court Judge Mary Ann Vial Lemmon handed down a sentence of time served—approximately four months in federal custody. With no additional prison time imposed, Gamboa-Reyes will immediately be turned over to U.S. Immigration and Customs Enforcement (ICE) to begin removal proceedings from the country.

Court documents reveal that Gamboa-Reyes was first removed from the United States on September 10, 2013. His return less than three years later triggered the federal prosecution, highlighting the long reach of immigration enforcement even in non-violent re-entry cases.

U.S. Attorney Kenneth A. Polite, who oversees the Eastern District of Louisiana, credited the investigation to the persistent work of Customs and Border Protection agents. Their role in tracking and confirming Gamboa-Reyes’s status was pivotal in building the case for illegal re-entry.

Assistant U.S. Attorney Jon Maestri prosecuted the case, underscoring the Department of Justice’s continued focus on immigration enforcement as a cornerstone of federal criminal priorities. Gamboa-Reyes now faces imminent deportation, closing a chapter on his second known unauthorized entry into the U.S.
